every single physical or moral person who wants to buy something on the www.bam-france.com website “the seller”, named in this document « the buyer ».

Second Clause - Subject

Those `General Conditions´ of selling define the contractual relations between the seller and the buyer and all conditions for every bought product on the seller’s website.

When you buy something on this website, you agree with all these `Terms and Conditions´, without reservation.


These selling conditions will prevail over all other general or particular conditions not certified by the seller.


The seller keeps the right to modify these selling conditions whenever he wants. At this moment, suitable conditions will be those in effect when the order is made by the buyer.

Third Clause – Characteristics of offered goods and services

Offered products and services are those in the published catalog and on the website www.bam-france.com of the seller.
These products and services (Case and accessories for IPhone and Samsung, leather goods…) are subject to availability, while stocks last.
Each product has a detailed description made by the seller (description, reference, price, picture)
Catalog’s pictures are as correct as possible but can’t be a perfect fit with the product, for example the colors and the perspective of photography.

Fourth Clause - Prices

Catalog’s prices are without VAT in euros with the 20% VAT added to the selling price at the date of purchase; every exchange rate change can be transferd on the products or services price.
The seller has the right to modify his prices anytime, but the suitable price will be the one set when the order was made.
The total cost must be paid when the order is made. The money paid is not a deposit.
The indicated prices don’t include order or shipment costs.

Fifth Clause – Geographical area

Online selling of products or services showed on the website www.bam-france.com is offered for those countries :
France, Monaco and Corsica, and the French overseas departments : Guadeloupe, Guyana, Martinique and La Réunion, as well as the two French overseas communities of Saint-Martin and Saint-Barthélemy.
European Union : Germany, Austria, Belgium, Bulgaria, Cyprus, Denmark, Spain, Estonia, Finland, Greece, Hungary, Ireland, Italy, Latvia, Lithuania, Luxembourg, Malta, Netherlands, Poland, Portugal, Czech Republic, Romania, Slovakia, Slovenia , Sweden.

Sixth Clause - Orders

The buyer who wants to buy a product or a service must :
- fill in the identification file with all the personal data asked (email address, password, gender, name, firstname, date of birth, company, address, zip code, town, country, phone number) ;
- fill in the order file online with all the products in your « basket » ;
- validate the order after checked it ;
- pay in the respect of the established conditions ;
- confirm the order and the payment.

The order confirmation is the agreement with those General Selling Conditions, the recognition of the knowledge of them and the waiver of his own buying or other conditions.
All of given datas and registered confirmations will be a proof of this deal. The confirmation will be as a signature and an agreement about those operations.
The seller will send you the registered order confirmation.

Seventh Clause – Payment terms

Price is due with the order.
Payment will be done by Paypal or Credit Card.
Buyer’s account will be debited with the products or services chosen price.
At buyer’s request, an invoice will be send by Post with VAT. This invoice is downloadable whenever from the customer’s account.

Eighth Clause- Order prepairing and shipment

When the order is paid by the buyer, he’ll receive in his mailbox a payment confirmation.
At this moment, the seller must send all the order between 24 and 48 hours after the payment from Monday to Friday (depends on the received orders volume).
From Monday to Friday, if the buyer ordered before 12 a.m., the seller can (depends on the volume of orders to prepair) prepair and send the order with in 2 working days.
All orders made Saturday or Sunday will be sent by the seller the following week Monday or Tuesday.
Shipments will be done to the address in the order file (exclusively in the geographical area of the Fifth Clause).
For France, the Post makes the shipment with a delivery time of 3 or 4 working days (indicative bases).
Risks are taken in charge by the buyer from when products quit the seller’s workshop. If there are damages during the shipment, a reclamation must be formulated to the carrier before 4 days after the delivery.
Delivery times are given on an indicative basis. The contract can be cancelled and the buyer reimbursed if the delivery time is more than 30 days after the order.
If the buyer ordered several products including one with a fabrication time longer than the others, the seller has the right to send all the products once the last one is ready.
The address is to verify by the buyer. The seller can’t be responsible about the non-delivery of an order if a detail in the address is wrong.

If the address or the name of the person linked to the delivery address is incorrect, or if nobody is here to pick up the package and if the order is returned to the sender, the seller then undertakes to inform the buyer. The seller's only choice will be to reship the order to the correct address. The buyer then agrees to repay the shipping costs to the seller.

Ninth Clause - Warranty

All the supplied products by the seller are under the legal warranty written in the clause 1641 and following in the Civil code of France.
If a selling product is in non-compliance, it’s possible to send it back to the seller who’ll repaid, exchange or take it back.
All complaints, exchange or repayment wish must be asked by letter to :

Concerning the website www.bam-france.com, we can’t guarantee the absence of viruses or a defects or of technical imprecisions on the website.

Tenth Clause - Responsability

The seller, in the online sales process, is only bound by an obligation of means; its responsibility could not be engaged for a damage resulting from the use of the Internet network such as loss of data, intrusion, virus, breakdown of the service, or other involuntary problems.

Eleventh Clause – Intellectual Property

All elements from the seller’s website are and stay the seller’s intellectual and exclusive property.
Nobody is allowed to reproduce, exploit, repost, or use for any reason whatsoever, even partially, elements of the site whether software, visual or audio.
Any simple link or hypertext is strictly prohibited without the express written agreement of the seller.

Twelth Clause - Litigation

Those General online Selling Conditions are submitted to the French law. If there’s a litigation.
In the event of litigation, competence is allotted to the competent courts of Lisieux (France, Normandy), notwithstanding plurality of defendants or call in guarantee.
